HOW TO ENTER

To enter, consumers must purchase an Energizer watch battery from a participating Mister MINIT outlet, have it fitted in store and SMS their name and store location (suburb or town) to 1999 2599 (Australian residents) or 2599 (New Zealand residents) during the promotional period. Australian premium SMS cost is 55c. Entrants must have premium service access. New Zealand SMS entry cost will vary dependent on the mobile network used but will not exceed 45c.

Entrants must retain their original Mister MINIT store receipt/s for all entries as proof of purchase. The Promoter may request the original receipts from the entrant to verify the validity of an entry and reserves the right to declare any entry for which an original store receipt/s cannot be provided invalid.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Entry into this promotion is deemed to be acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia and New Zealand. Employees (and their immediate families) of the Promoter, participating outlets and their agencies associated with this promotion are ineligible to enter or win.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to and to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Terms and Conditions including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Australian premium SMS cost is 55c. Entrants must have premium service access. New Zealand SMS entry cost will vary dependent on the mobile network used but will not exceed 45c. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant. Vodafone pre-paid users are unable to participate by SMS because of Vodafone network restrictions. Service provider is 5th Finger.
5. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) limit to one entry per person per day.
6. Entrants must retain their original Mister MINIT purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry.
7. Competition commences at midnight AEST on 01/09/07 and concludes at 11.59pm AEST on 30/09/07. The prize draws will take place at 30thirty Pty Ltd, 9am AEST at Level 2, 50 Yeo Street, Neutral Bay NSW 2089 each day from 02/09/07 until 01/10/07 inclusive. Entries received between midnight AEST and 11:59pm AEST for each day from 01/09/07 and 30/09/07 inclusive will be entered into the draw for that day, which will take place on the following business day. All non-winning entries will roll into subsequent daily prize draws. Prize winners will be notified by phone. Judges’ decision is final and no correspondence will be entered into.
8. The first valid entry drawn in each draw will win $50 in the form of a money order made out to the winner. Australian winners will receive $50 AU and New Zealand winners will receive $50 NZ.
9. Total prize pool is $1,500. Prizes are not transferable or exchangeable. Winners must allow 28 days for delivery of prizes.
10. If a winner is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.
11. The Promoter may conduct such further draws at the same place as the original draw as are necessary on 28/01/08 in order to distribute any prizes unclaimed by that date subject however to any written directions from a regulatory authority.
12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
13. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or entrant; or (g) a prize.
14. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
